Participant Acknowledgment: I, the undersigned participant (or parent/guardian if the participant is a minor), in consideration of being allowed to participate in martial arts training and other activities ("Activities") conducted by Gracie Barra Dana Point ("Facility"), acknowledge and agree to the following terms:

Release and Waiver of Liability: I hereby release, waive, and discharge Gracie Barra Dana Point, its directors, officers, employees, volunteers, and agents (collectively, "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury (including death), or exposure to and infection with COVID-19, that may be sustained by me or any property belonging to me, while participating in such activity, or while on the premises where the Activities are conducted.

Assumption of Risk: I understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to physical injury, illness, disability, and death, as well as the risk of exposure to COVID-19. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the Facility or participation in Facility programming ("Claims").

Indemnification: I hereby agree to indemnify, defend, and hold harmless the Releasees from and against any and all Claims resulting from my participation in the Activities, including, but not limited to, those related to COVID-19 transmission.

Health Declaration: I attest that I am not experiencing any symptoms of illness such as cough, shortness of breath, or fever, have not tested positive for COVID-19 within the past 14 days, and have not been exposed to someone with a confirmed or suspected case of COVID-19. I agree to notify Gracie Barra Dana Point immediately if I develop symptoms of COVID-19, test positive for COVID-19, or become aware of any potential exposure to someone with COVID-19.

Severability: If any provision of this Waiver and Release of Liability is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Waiver and Release of Liability shall otherwise remain in full force and effect and enforceable.

Acknowledgment: I have read this Waiver and Release of Liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this waiver freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
