Flooring Purchase Agreement

Terms & Conditions

Payment Terms:

Upon signing this flooring contract, I understand that for purchases not financed, 50% of the project's total cost is required as a deposit. This deposit is payable upon signing and serves to secure materials for the project. The remaining 50% is due upon delivery of materials to the customer's home, payable upon receipt (COD). Installation will commence only after the COD payment has been made in full. Failure to complete payment prior to installation will result in a delay until full payment is received by Floor Daddy, LLC.

Acknowledgment of COD:

I hereby agree to settle the Cash On Delivery (COD) monetary balance in full on the day of installation or prior to installation using certified check, money order, or credit card only. I understand that personal checks are not accepted.

Credit Card Convenience Fee:

I acknowledge that there will be a 3% convenience fee applicable to credit card transactions. This fee will be charged in addition to the total cost of the flooring products or services acquired.

Special Accommodations: 

Any deviation from the above payment terms must be pre-approved in writing by an authorized representative of Floor Daddy, LLC.

Financing Terms:

I understand that if credit has been established with a financing firm, the entire amount will be debited from my account prior to installation, unless additional funds are provided. I understand that the initial payment to the financing firm must be made within 30 days following the signing of the contract. No verbal agreements from either party can alter these terms.

Floor Preparation Disclaimer:

I acknowledge that all floor preparation is essential before proceeding with any flooring installation, adhering to ROC code and manufacturer specifications. The floor must meet industry standards for levelness and smoothness to ensure the quality of our work. Without proper preparation, we cannot guarantee the outcome of the installation.

Foundation Conditions:

I understand that the condition of the foundation may present unforeseen challenges, which may incur additional charges. These charges must be paid in full before commencing any additional work. Any necessary repairs will be billed accordingly. Floor Daddy, LLC is not liable for floor failures caused by slab leaks or moisture, and any associated costs for repairs or replacements are the homeowner's responsibility.

General Terms and Conditions:

This agreement is subject to Floor Daddy, LLC manager approval, and no verbal commitments are recognized. The contract is governed by the laws of the state of Arizona, where the work is performed.

Excess Materials:

Any excess moldings or materials are the sole property of Floor Daddy, LLC, and no deductions are allowed for them.

Property Ownership:

All products and materials remain the property of Floor Daddy, LLC until the contract is paid in full.

Enforcement and Validity:

This agreement is enforceable under the laws of the state of Arizona, where the work was performed, and any invalid provisions do not affect the overall validity of the agreement.

Delivery and Unforeseen Circumstances:

I understand that the delivery of merchandise is contingent upon unforeseen circumstances, weather conditions, pandemics, strikes, and other uncontrollable events. Floor Daddy, LLC holds no responsibility for damages related to delays in performance.

Installation Guidelines:

It is expected that I will be present at home on the first day of installation, recognizing that specific arrival times cannot be scheduled.

Customer Responsibilities:

I am responsible for moving fragile items before installation, including but not limited to: pianos, grandfather clocks, picture frames, and pool tables. 

Seam Placement:

I understand that Floor Daddy, LLC has discretion over seams, direction, and installation. It's recommended to vacuum carpets after installation.

Liability and Damages:

Floor Daddy, LLC shall bear no responsibility for any damages that may arise as a consequence, either to the premises or the materials therein. Scratches or harm to walls, moldings, and trim may occur due to the material's size and the installation process. This includes, but is not limited to, unintentional damage to appliances, landscaping, gas lines, electrical wiring, plumbing, telephone installations, or personal property. Installers shall not be held accountable for any harm to TV cables, telephone wires, alarm wires, water pipes, gas lines, or damage to water lines connected to toilets, appliances, sinks, etc. Floor Daddy, LLC does not engage in the disconnection of gas or water lines linked to appliances, and any associated liability is disclaimed.

Material Acclimation:

In addition to the contract terms, please be aware that a $150 material delivery fee applies. It's essential to note that flooring materials require acclimation due to their susceptibility to temperature and humidity fluctuations. Acclimation involves allowing the flooring material to adapt to the installation environment. This step is crucial, especially for materials such as hardwood, laminate, and engineered wood, as they may expand or contract when subjected to varying moisture levels.

Installation Guarantee:

Floor Daddy, LLC, provides a lifetime residential installation guarantee applicable to the original homeowner and the initial installation only. This guarantee is subject to voidance in cases of customer abuse, neglect, acts of God, improper cleaning, water damage, or other causes unrelated to improper installation. Additionally, damages resulting from roller chairs, particularly those affecting vinyl or laminate surfaces, will void the warranty/guarantee. It is required that office chairs be equipped with fiberglass floor mats underneath them, and Floor Daddy shall not be held responsible for any damages caused by such chairs.

Flooring Characteristics and Maintenance:

I recognize that flooring materials may exhibit natural characteristics, and variations in trims, transitions, and moldings are inherent to real wood or stone products. Flooring must be exposed to reasonable indoor temperatures and humidity to avoid non-warrantied damage. I am aware that Floor Daddy, LLC offers a lifetime residential installation guarantee under specified conditions.

Cleaning Instructions:

To prevent damage, I agree not to clean laminate, luxury vinyl plank (LVP), or wood floors with wet mops, harsh chemicals, or products containing wax or oils. Failure to follow approved cleaning methods may void warranties.

Notice of Right to Cancel:

I acknowledge that I have the right to cancel this flooring contract within three business days from the date of signing, and I comprehend the procedure for exercising this right. I understand that should any work commence before cancellation, that I am responsible for any costs incurred up to the point of cancellation. It is clear to me that I retain the right to cancel within the initial three business days following the contract date.

Restocking Fee:

I understand that should I choose to cancel after this three-day period, I am subject to restocking fees, totaling 35% of the total contract price, and any deposit paid becomes non-refundable.

Dispute Resolution:

All disputes must be resolved through arbitration, and Floor Daddy, LLC cannot be sued in small claims or other courts.

Home Solicitation Sale:

This agreement is based on a home solicitation sale and is subject to Arizona Title 44, chapter 15. It is not negotiable.

Right to File a Complaint:

You have the right to file a written complaint with the Arizona Registrar of Contractors for an alleged violation of A.R.S. 32-1154, subsection A. Manager Approval:

This agreement is subject to approval by Floor Daddy, LLC management.

Customer Acknowledgment:

I acknowledge that this agreement represents the entire understanding between me and Floor Daddy, LLC, and any changes must be in writing and signed by both parties. Any changes to the scope of work must be documented in writing and signed by both Parties. Additional costs incurred by such changes are the responsibility of the Client and are due upon completion of the additional work.

Entire Agreement: 

This document and any attached exhibits constitute the entire agreement between the Parties. Any prior understandings, agreements, or representations are superseded by this Agreement.

Legal and Binding Agreement:

This Agreement is legal and binding between the Parties as stated above. The Parties each represent that they have the authority to enter into this Agreement.
